HC rejects woman``s plea to revive OCI card

New Delhi, Jul 6 (PTI) The Delhi High Court has rejected the plea of a woman seeking direction to the Centre to revive her Overseas Citizen of India (OCI) registration which was cancelled on the ground that she concealed the fact that she had Pakistani citizenship till 1990. Justice S Muralidhar dismissed the petition filed by Syeda Afshan Rehman who was granted OCI card as a Canadian citizen but it was withdrawn as she had also acquired Pakistani citizenship. The court upheld the decision of the Union Home Ministry cancelling her OCI registration on June 13, 2008. "The failure by the petitioner (Rehman) to disclose complete facts and in making a false statement in her application for grant of OCI registration clearly attracted the ground (taken by the MHA) under the Citizenship Act," the court said. The woman, in her plea, claimed she was born in India but her father was posted at Chittagong in East Pakistan and died in 1971 Indo-Pak war. In 1978, she travelled to see her grandmother in Patna on a passport issued to her mother by Pakistani authorities. She claimed she married an NRI working in Singapore but later migrated to Canada. She was issued an Indian passport in 1999 and later was also granted Canadian citizenship in 2000. According to the MHA, her estranged husband brought to the notice of the authorities that she had held the Pakistani passport, prompting them to cancel her OCI registration. The MHA further contended that the OCI registration could not be issued to a person holding Pakistani or Bangladeshi passport. "A PIO (person of Indian origin) should never have been a citizen of Pakistan or Bangladesh," the authorities submitted, claiming they had documents to substantiate their claim with regard to the woman''s citizenship.
