Jaipur, July 7 (PTI) Taking serious note of alleged torture by the CBI of a key witness in the Dara Singh fake encounter case, the Rajasthan High Court today directed the investigating agency to appear before it with the case diary. Asgar, a key witness in the fake encounter case being probed by the CBI, had earlier filed a petition in the High Court alleging that he was being tortured by the investigating agency to change his statements. He had also sought police protection for himself and his family. Justice Ajay Rastogi took serious note of the charges levelled against the CBI in the petition and directed the investigating officer to appear before it with the case diary. "This is a shocking incident, if true, the CBI is not supposed to deal in such a manner with the key witness who is otherwise deposing in favour of the prosecution and the allegations levelled are very serious," observed Justice Ajay Rastogi. Earlier, the court had on July 1 asked CBI to file its response to the petition filed by Asgar. "In its reply, CBI though admitting that the key witness was called, failed to produce any such notice of attendance when asked by the court," said Ajay Kumar Jain counsel for the petitioner. Dara Singh alias Dara, a histroy-sheeter, was allegedly killed in an encounter while making a bid to escape from police custody in Jaipur.
